Last week, on April 29th, the "ENERGISA Group," an electricity distribution company, suffered a "cyber attack" on its online services portal, as reported in the regional and national press.
Due to the invasion of hackers (likely of foreign origin) several customer services stopped working and it is unclear whether consumer data was “leaked”.
If customer data security has been compromised, the damage can be enormous, including legal repercussions. If the LGPD – General Data Protection Law – were in effect, the damage to the company due to the attack would be extremely greater, as the LGPD is very strict regarding this type of occurrence.
However, the Senate recently approved postponing the application of sanctions related to the LGPD (Brazilian General Data Protection Law) to August of next year (it was previously scheduled to begin in August of this year) and the law's entry into force on January 1, 2021 (which the Federal Government, through Provisional Measure No. 959/20, extended to May).
ENERGISA Group, Hackers and the LGPD (II)
Even though the penalties under the LGPD (Brazilian General Data Protection Law) can only be applied from August 2021 onwards, "legal proceedings, class actions and legal appeals" can begin as early as May of next year.
Regarding "data leaks," the LGPD (Brazilian General Data Protection Law) has several articles specifically related to "compensation for damages (caused by leaks) and the security and confidentiality" of data stored by companies.
I will highlight here only three (all transcribed verbatim). Article 42 specifies the following: “The controller or operator who, by reason of carrying out the activity of processing personal data, causes patrimonial, moral, individual or collective damage to another, in violation of the legislation on the protection of personal data, is obliged to repair it.”.
Article 46 states the following: "Data controllers must adopt technical and administrative security measures capable of protecting personal data from unauthorized access and from accidental or unlawful destruction, loss, alteration, communication or any other form of inappropriate or unlawful processing.".
Finally, Article 49 specifies the following: “The systems used for processing personal data must be structured in such a way as to meet the security requirements, the standards of good practices and governance, and the general principles set forth in this Law and other regulatory standards.”.
These three articles of the LGPD (Brazilian General Data Protection Law) would apply to the event that occurred, if the law were in effect. It remains to be seen what position ANEEL – the National Electric Energy Agency – will take on the matter.

Helmet
A "helmet with respirators" that "provides a ventilation system without the need to intubate patients" (thus being non-invasive), a procedure necessary in severe cases of COVID-19 patients, was developed by researchers at UFPB – Federal University of Paraíba.
The equipment from Paraíba is being tested at the Hospital das Clínicas in São Paulo, and after its functionality is validated, ANVISA – the National Health Surveillance Agency – should authorize its use in the national health network.
It will be yet another technology product,“made in "Paraíba", used in the fight against the coronavirus pandemic.
